Subj: Old Lucky's Store

Now that Lucky"s has become Albertsons doesn't this break their lease agreement where they use to be? Now that the 24 hour training thing is not going in maybe we can check with the mall owners and see if a small grocery store can be put in.

Good question! It is my understanding that even under a change of ownership, the deed restriction that is preventing any other grocery store in the Plaza de Santa Teresa shopping center, would continue to be in effect. It is entirely up to Albertson's (since they now own Lucky's) to ever remove the deed restriction preventing grocery services in Plaza de Santa Teresa. Also, the deed restriction remains in effect even if Albertson's (Lucky's) sells their building to another party. Bottom line: Grocery services will never again be in Plaza de Santa Teresa unless Albertson's allows it by removing the deed restriction. [SAS]
